A group is forming to start the task of identifying rentals and checking their status ..all those not in compliance will be reported to IRS

Did you know that all rental properties must be registered with the county? You can check the status at https://mcassessor.maricopa.gov/. If the unit isn't registered, my guess would be that the owners aren't paying taxes either. Sometimes the IRS can be useful in dislodging problem tenants

No One Here ??
After calling office yesterday to place complaint about the unit in Build 5, I was called back by Sharon, Who I must say always returns my calls and for this thank you!
Well Wayne is on vacation ( Well Deserved ) , Paul Jensen is in Canada and dont believe Ray is here either, so we are left with Marta or Dana..That's a loss...This only leaves the REAL FULL TIME BOARD MEMBER TO HELP....BOB P....
REMEMBER HE HAD THE MOST VOTES HERE IN THE LAST 10 YEARS, AND YET IS SHUT DOWN BY THIS BULLS**T VISITOR BOARD WE HAVE.

Maids Not Included
Last year during the winter months a few winter residents got their panties in a bunch when we made the comment that MAIDS DO NOT COME WITH UNIT PURCHASE
Well yesterday a few residents and I were talking and one resident, asked why all of a sudden do we have maintenance men fixing chairs at pools every morning this week ??
THE ANSWER ....During the summer months full time residents clean pool area when leaving and now we have winter residents drag chairs around pool and leave them everywhere.
This makes it hard to get by the skinny paths next to tables, older people dodging chairs etc

So to our Winter Visitors ...why should HOA spend 2 hours payroll every morning to clean up after your pool use

I have received a few letters of complaint about my alleged dislike for winter visitors and I would like to clarify a few things since this has been addressed !
First Let me start by saying I have made my personal opinion about snowbirds to far ranged, and for that I must backtrack and admit my mistake
I have a group of winter visitors that I look forward to seeing every year and some have been here as friends for over the last 10 years so putting them into the small group of winter visitors that many here have the same opinion of.
Yes we have a group of winter residents that have decided to make our home their winter playground, Many of these are the buyers who bought here in last 3- 5 years during the housing boom, .Some just don't know how to act in a upscale community, But we have acquired them none the less.
So maybe it is time to just actually just address them here and not all winter residents as one
We have snow birds, ....... and those who dont know how to act when here we will refer to as Snow Pigeons ...lol
But I must assure you this is not a one mans opinion here.....A large group of full time residents also feels the same..Now can the community get together as one...this will depend on attitudes from both sides to be equal!
But I want to say to winter residents to think from our side also...we live our lives the same here 360 days a year, we all have our own lifestyle we lead, Then in winter , you come and want to change rules that affect our lifestyle,keep pools open later and open earlier,noise at all hour at jacuzzi, not realizing we have windows open..we didn't just come from the tundra. or plan parties that are paid for by community ?? This is absurd and the respect will never be mutual here as long as this kind of game if going on

More Short Term Rental Cons
One of the issues that many HOAs grapple with is renters. Some ban them outright, others limit their number. Most live and let live. Interestingly, the HOA has no direct legal authority over renters, only its members. This disconnect creates some practical problems for the board or manager in communicating with tenants since there is always a middle person to deal with. So how does this all play out?
Rules Enforcement. The HOA has the right to expect all residents, whether owner or renter, to play by the rules. But with renters, it's up to the landlord to enforce them, not the HOA.
So, the board should adopt a policy that requires all landlords to provide a set of the governing documents and all rules that have been adopted that affect the renter. The Board can also require that all rental agreements specifically make reference to and be subject to those documents.
If a tenant violates a rule, the landlord should be informed of it immediately along with the expectation of enforcement. If there is a fine or penalty, the landlord should be levied for it as if he did the dirty deed himself. It's up to the landlord to get reimbursement from the tenant.

There are several exceptions to the landlord middle man enforcement process. If a tenant parks illegally in a fire lane, the HOA has the authority to have the car towed and the tenant will, naturally, pay to retrieve the car. There are some things the HOA should not interfere or get involved with.
When a renter crosses the line between HOA rule and civil law infraction, the HOA has the right to call in proper authorities. Those authorities include the police, fire safety, FBI and drug enforcement.

Short vs. Long Term Rentals. Most HOAs deal with renters who have entered into long term rental agreements (30 days or more).
Most governing documents, in fact, require that the rental agreement be long term to avoid what would be a hotel operation. In resort areas, (mountains, beach, etc.) the HOA may have been expressly built and sold allowing owners to rent their homes short term. However, unless virtually every owner has that in mind, there will be an ongoing clash between permanent residents and short term renters. Short termers have no allegiance to the community, don't know the neighbors and frequently are in party mode.
These factors point to ongoing problems with the locals. If this is a reality, it's important for the board to press for consensus among the owners. If the majority want the flexibility to short term rent, it makes sense to have an onsite manager to control these issues and others like key exchange and housekeeping. The manager could be funded partly by the HOA to handle regular maintenance and partly by landlords to care for rentals. It's a win/win.
Controlling Tenants. Renters generally are no better or worse than owner residents. Ongoing problems result from lack of landlord standards (or enforcement of those standards) by the HOA. Here are Landlord Standards which all HOAs should adopt:
- Landlords must provide a set of governing documents (CC&Rs) and rules to renters before move in.
- HOA rules & regulations must be a condition of all rental agreements.
- Landlords are held accountable for renter infractions.
- Renters must communicate requests to the HOA through the landlord.
- Board may demand termination of a tenant with multiple rule violations.
- Landlord must provide a copy of each rental agreement to ensure compliance with the HOA's standards and for emergency contact purposes.
Renter Surcharges & Fees. Some HOAs impose a Move In/Move Out or Renter Fee on landlords. Unless this fee is imposed on all residents, owner or renter, it is discriminatory. If a particular renter causes damage to the common area moving in or out, the landlord should be charged for it. Never surcharge classes of residents.
Communicating with Landlords. All tenant violations should be directed to the landlord in writing along with specifics, including date and time. The communication should be clear on what the landlord's course of action should be. It should also reinforce that it's up to the landlord, not the HOA, to deal with a renter.
Limiting Rentals. At one time or another, someone may press to limit rentals. There are right reasons for doing so, but avoid the wrong one: The belief that renters are undesirable. While some tenants may be problems, so are some owners. Each must be dealt with as individuals, not a class. The only valid reason for limiting rentals is to protect financing and market values. Many lenders view HOAs with a high number of rentals as investment property. Investor loans are more expensive and in a tight market, loans may be hard to get. Since availability of cheap money drives market values, it's important to avoid lender restrictions.
Although there is no hard and fast guideline, maintaining at least two-thirds owner occupancy seems to pass muster with most lenders. Falling below that level causes closer scrutiny by some lenders. When lenders scrutinize, it usually means the interest rate or fees go up. Restricted financing options cause market values to fall.

This issue is coming to a head in San Francisco where the City Attorney has brought action against two landlords for practices that amount to converting residential buildings into pricey tourist hotels after evicting long term tenants, two of them disabled. The units in these buildings are now being used as short term rentals. Short term rentals are typically leases for less than thirty days.
So, one may ask “what’s the big deal?” From the standpoint of a municipality, these landlords are likely not collecting and subsequently paying the city’s hotel tax.
From the standpoint of an owner in an HOA, the resident owner’s property interest may become overrun with tourists. The tourists may abuse and overuse the common area facilities. Over time, the common area may see significant impact requiring excessive expenditure from the general funds of the association or requiring premature use of reserve funds.
Furthermore, the resident owner may see his property value decline or not reach its full potential.
The governing documents of many associations prohibit short term rental activity, but how does one monitor such activity? Neighbors may keep a watchful eye and report suspected activity to the board or to the association’s community manager. To be more proactive, the board or community manager may be able to use the same online tools potential renters use to discover short term rental properties within their association. Websites such as Airbnb, VRBO and HomeAway are often used by short term lessors and lessees alike to both list and locate short term rentals.

BUT THAT HAS BEEN OVERTURNED JUST IN TIME FOR WINTER FLOCK
Then this is published, THE BOARD HAS TIME TO PLAN ACTIVITIES FOR SNOW BIRDS...
.BUT NO TIME FOR IMPORTANT ISSUES PLAGUING US WHO LIVE HERE YEAR ROUND (OUR HOME) Including catered events ?????

October: A guided tour of the Musical Instrument Museum (MIM). Wed., October 21 at 10 am. Cost is $20 payable at the Museum. A sign-up sheet will be posted in the Clubhouse shortly. Nov. 20, 2015:
A meet and greet social hour in the clubhouse. Bring an appetizer to share, a drink of your choice and a can of food for a local food pantry. Nov. 20th , 3:00 pm to 7:00m pm.
December: Holiday Party at the clubhouse. Dec.18th at 6:00 pm, this will be a catered affair. More details later.

Locking of Pool Gates There are residents in the community that would like to use the pools before 8:00a.m. so it has been requested to open the pools earlier in the morning.
Paul Jensen made a motion to change the pool hours to open at 6:00a.m. and close at 12:00a.m.
Faye Roberts seconded the motion. All in favor; the motion carried unanimously.
Included in this motion was that the gates would not be locked during the night
and security was to be asked to check the pools at midnight and before they leave for the restricted hours of use

AFTER 6 MONTHS OF NO SECURITY OR POLICE REPORTS AT POOL SINCE THE LOCKING..AND THIS FOOLISH DECISION
First off this action was taken many months ago after many complained about late night trouble at pools
So this is the decision you have voted on ??
We did not enjoy the quiet evenings with NO COMPLAINTS ????
Well A group of us has decided any time we have issues in pool after midnite , we will go knock on Board Members Doors to alert !! Don't like the idea ?? Tooo Bad .. we don't like your vote !!

Very Interesting Idea's
After talking and meeting with a large group of residents, who had wanted to discuss options for Board to consider with long overlooked "Short Term Rentals" here at Anasazi.
This growing group has met on 2 occasions and have looked into solutions by other HOA communities who face the same problems and what they enacted to stop the problem
What many of you do not realize is with short term..(Weekly, Nightly) We can be classified a hotel which would reduce our property values significantly.
Here is some of the ideas from our own Residents and Other HOA's of the Caliber of Anasazi
and yes all would have to be looked at by Anasazi Atty
The first is to set a real fine rule in place
1ST Infraction - Warning Letter
2nd Infraction - $100 Fine
3rd Infraction - $500 Fine
4th infraction = No rental for 1 year
If owners are getting $3000 a month our policy now of 3 warnings and then a $50 fine is non threatening from the start...Whats a $50 fine on some who takes in $15,000 in rent ??

Now 2 other HOA'S Here and some in Florida have set stricter rules to keep property values up
In Arizona and Florida many HOA'S Have clauses that new buyers cannot rent for the 1st year of ownership
Also many Communities only allow 1 Rental per year up to 6 months
or 4 rentals a year of 3 months ?
This above solution would eliminate 80% of the management companies here and also stop many of the short term rentals here..Many on board for this idea here and after further meetings in further weeks we will have a plan drawn by someone with legal background

The "Smooth" Transition Continues !
As The "SMOOTH TRANSITION" CONTINUES,

Many residents this holiday weekend held hostage by 12 hour frames of repairmen coming to fix cable problem here,
My wife was helping a lady here in building 5 and was told by DISH we would be there
on Saturday between 8am -1pm....
HE ARRIVED AT 7:30PM..
.On Sunday and Sunday morning the trucks filled the lot again with many waiting their turn to have tv
AND THE BOARD BROKE ITS OWN RULE OF NO VENDORS OR WORKERS HERE ON WEEKEND AND HOLIDAY..YES WE KNOW IT WAS NEEDED..BUT RULES ARE RULES ??
What happened to all the posted letters about this being a smooth transition??? You all know we were fed the kool aid again
The thing that has most residents upset is....FOR THE LAST 8 YEARS
Many residents asked at every meeting, over a 100 residents had consistently asked when cable contract is up
THE PROBLEM IS HOW COME NO RESEARCH WAS DONE ON CABLE COMPANIES TO THAT POINT WHEN WE KNEW OUR COMPANY WAS ENDING IN A YEAR..NOW THEY ENDED IN A SHORTER PERIOD.
.BUT NO BOARD MEMBER TOOK THE INITIATIVE TO DO THEIR HOMEWORK AND GET THE BALL ROLLING
MANY I HAVE SPOKE WITH HERE WANT COX.......WILL THIS EVER GET A VOTE ??
Maybe we start making sure Board members are educated..not just volunteers with friends voting

IF YOU RECALL THESE RENTERS WERE CHARGED ALLEGEDLY ON A LATER DATE IN A DRUG AND GUN RING, OF WHICH OPERATED OUT OF ANASAZI DURING THE SUMMER,
WE HAD UNDERCOVER OFFICERS WATCHING HERE FOR WEEKS, WHILE RESIDENTS LIVED IN THE MIDDLE OF THIS
The month before we had drunken residents break into another residents home while sleeping

Another Longtime Eatery Gone
To many Anasazi residents and also winter residents COCO'S was a great place to have a meal or also enjoy the Friday Night Socials they used to have on Fridays attended by many of our residents

Can We Focus On the Important Issues First ?
I had a discussion with some residents the other evening, and a good question came up in regards to budget
1st Pool 3 has had no misters for the last 5 weeks, the hottest part of the summer, when asked why ? the explanation is there is a leak and it would cost $2000 to repair so we are searching for a different
solution!
Now if we are wasting hundreds of gallons of water on a regular basis, Would it not be worth the money to fix the problem correctly
Also we have pool guy here only 1-2 times a week, still have needles and dust in jacuzzi from storm 3 days ago?
Winter residents here , we have pool man every day ? Services should be equal for all HOA owners
Next we have over 12 sprinkler leaks on property that crew cannot keep up with, In previous years we brought in an outside person to get this problem squared up..agin water leaks cost very much..
Why are we piddling around with these jobs that are really not very expensive to complete and be done the right way from the start.
Why this Board has been in Hiatus ALL SUMMER LONG!!
Then I come home and for the second time this week, I receive an email from a company thinking I am the Anasazi HOA Board
With the info HOA has inquired about with social committee here..It will be printed below..And to the Board I replied for You..We are not interested ..lol
Now For starters I was in favor of a social committee here till it became verrry one sided, I still hope it can be salvaged. But it has 1 full time resident and all the rest out of country owners or short term winter residents .And Ray the Board member , Yet a very nice man ..only stays here 90 days and is in control of it with other winter friends.
So Many Ask the question
Where were the social activities for July 4th or the social fun here for Labor Day ??
NONE !!!
So again we are to believe that it should be for winter residents time here only,
I think they need to realize activities did not come in unit when bought ..lol
Many here disgruntled also and worries our board will use HOA money to pay for these events
Or turn our community into a wine fest spring break for seniors who spend winters here

Based on an inquiry from the HOA, I would like to share information about visiting the Musical Instrument Museum (MIM), rated #1 attraction in Phoenix by TripAdvisor. Not only does MIM provide a one-of-a-kind guest experience to be enjoyed by guests of all ages, but there are over 200 concerts scheduled annually and there are monthly signature events focused on global cultures. Open daily from 9 – 5 daily (except Thanksgiving Day), it is easy to plan a visit or tour.
For groups of 10 or more, a Museum Guide can be arranged. Guests who visit spend an average 3 hours at MIM visiting the Geographic Galleries, the Artist Gallery and more. I welcome the opportunity to provide more details or visit www.mim.org.

MORE CONFUSION !!
I have received over 10 phone call messages today and yesterday,
from MANY RESIDENTS.
Who have NO CABLE and CANT GET FOR AT LEAST A WEEK...
One resident said a month
My elderly neighbor asked my wife to help her tomorrow as she cant get any help

Another resident said she talked with a board member and they said the only ones that know anything are Faye and Paul ?? And are not sharing info with all board members

Boycotting Board Meeting !1
After discussion with Family trust yet another day this week,
I have decided to boycott this Board meeting for 2 reasons..
The first is No one here at this time is really the head of the board..
And I personally only to this point trust 2 Board Members ..
The other 5 are useless, Thats a story for another day!
This meeting will be the same as always the 7 ladies and 2 men who attend and cheer and the couple people that will continue to moan about what this WEBSITE SAYS...To no avail ,
They have NO Control ...just as the small handful of "Winter Residents cry over this website ..
The crowd will be the same that drinks the Kool Aid this board is trying to serve..
They will follow what is told as in all years before.And not see any logic to what has happened.
